Tarculovski's defence to file notice of appeal on Friday at the latest
The Hague, August 7 (MIA) - The defence of Johan Tarculovski tomorrow (August 8) at the latest, when the deadline expires, will file notice of appeal to the judgement reached by the Trial Chamber of the Hague Tribunal, which on July 10 sentenced him to 12-year imprisonment regarding the "Ljuboten" case.
The Hague Court has rejected defence's motion for extending the time to file the appeal.
Tarculovski's counsel Antonio Apostolski, who is in the Hague, has said that the notice of appeal was prepared and would be filed on time. It covers 15 counts and 15 assertions, encompassing the entire judgement on all counts.
The defense will appeal wrongful application of material law and wrongful determination of facts. After the notice of appeal is filed, the counsels have to elaborate it before the judges within a period of 75 days. Until final decision is reached on Tarculovski's appeal, he remains in the Scheveningen detention unit.
In the meantime, the Office of Hague Prosecutor Serge Brammertz submitted an appeal against the acquittal of former Minister of Interior Ljube Boskoski.
According to the prosecutor, "had the Trial Chamber applied the correct legal standards to the facts of the case, it would have found that Ljube Boskoski failed to take the necessary and reasonable measures to punish his subordinates and would have convicted him".
Moreover, the Prosecution requests the Appeals Chamber to reverse the acquittal of Boskoski for murder, wanton destruction and cruel treatment, to apply the correct legal standards and to convict him on all counts of the indictment.
Ljube Boskoski was cleared on all counts of the indictment, whilst Johan Tarculovski was found guilty and was sentenced to 12 years in jail.
